The Nassau County Police Department reports an arrest of a Westbury man for Aggravated Driving While Intoxicated (Leandra’s Law) on Tuesday, September 27, 2022 at 7:25 AM in New Cassel.
According to Police, Officers responded to Elton Street near the intersection of Anna Avenue for an auto accident where a 2002 grey Dodge Ram 1500 struck an empty parked vehicle before leaving the scene. A short time later, the vehicle was located on Union Avenue near the intersection of Grand Avenue and a Vehicle and Traffic Law stop was conducted. A Field Sobriety Test was conducted with positive results and the operator of the vehicle, defendant Eyler Ortiz Alvarado, of 351 Madison Street, was placed under arrest without incident. The vehicles passengers included three juveniles ages six, four and three years old. Defendant Eyler Ortiz Alvarado along with the three juvenile victims were all transported to a nearby hospital for assessment.
Defendant Eyler Ortiz Alvarado is charged with three counts of Aggravated Driving While Intoxicated (Child under 16) under the Leandra’s Law, three counts of Endangering the Welfare of a Child, DWI Previous Conviction Designated Offense Within 10 Years, Operation of an Uninsured Vehicle, Aggravated Unlicensed Operation 3rd degree, and multiple Traffic Infractions. Defendant Eyler Ortiz Alvarado was arraigned on Wednesday, September 28, 2022 at First District Court, located at 99 Main Street, Hempstead.
